I recently purchased a trailer, which had a cancelled registration (last registered 10 years ago). The purchase was all above board. I purchased it from a guy that refurbs trailers as a side business. He showed me some of the frames of other trailers he was refurbing.

 

The trailer has a WOF that is valid until the end of the year, but no rego. What I didn't understand at the time of purchase was that the transfer of ownership works differently if the vehicle is not currently registered. I said to him at the time that I would sort out the change of ownership later that night. If it were a car, I would have done it on the spot.

 

My understanding is that it's now on me to re-register the trailer, but I'm having difficulty understanding what the process is. The NZTA website says I need sufficient proof that I should own the vehicle. The only real proof I have is the Trademe auction that I won. The seller isn't very responsive to my emails, but that isn't unusual for him.

 

What would be my best next step?

I take it you got a receipt from the Trademe dealer? Even just a hand written one

Can't you just register it as a new trailer, homebuilt. Get new plates etc and 3 years of WOF.

You can't get a WOF without a rego!

 

WOF needs a rego to be attached to.

Can't be done with a car but I think different rules apply to trailers.

An already registered trailer needs a current wof to be relicenced. A new trailer needs registration before a wof.

I suspect the existing wof died when the trailer was deregistered. The NZTA are supposedly looking into the loophole of old trailers being reborn. This report from Jan 2019 https://www.odt.co.nz/news/dunedin/trailer-wof-loophole-inquiry. As it's only been about a year and a half they've probably done nothing.

I thought I'd corrected myself. Registered trailers can be relicensed without current wof.

I did this a few months ago, but in my case it was a new trailer.

 

You can just go to a VTNZ and register the trailer. You just need the make, model, and year to do so (maybe a chassis or serial number if it has one). They don't need proof of ownership or to see the trailer. They will give you a new number plate and a label to attach to the trailer, I believe it comes to around $100 or so.

 

Once you have the registration, you take it for a WOF to be road legal.

 

In your case I'm wondering how it could have a legal WOF without a registration - what did they write as the registration number on the WOF sticker?

Yes, I do have a written receipt. Do you think that would be enough proof?

I was a bit confused by this also. The WOF has the cancelled rego written on it.

Why make life hard for yourself. Because it's been unregistered for so long it probably needs a fresh registration anyway. I've had this exact case where a trailer was deregistered, and the person at the counter of the WOF place suggested it was the simplest solution. New registration, pay for the rego, pay for the WOF. Done and dusted and on your way. Govt gets some $ and you are compliant.

Just 2c on ownership.

 

NZTA ownership in terms of vehicles means nothing. I can grab any random rego and go register the car in my name. That's just where they send the renewal reminders, fines etc to. As others have said they don't ask for proof of ownership to register a vehicle (well they didnt ask last time I did this - new trailer 3 odd years ago, various second hand cars sales etc).

 

Who legally owns the vehicles is a different matter. Generally this doesnt matter either unless theres a legal dispute (stolen), interested party (finance owing) etc and again Ive never been asked this. Even for insurance purposes you just tell them who the finance is through they dont ask for proof of ownership.
