I bought iPhone 3G 16Gb in Dec 2008. I also subscribe to PhoneInsure as well because I was told by Vodafone Rep that if something happens to your phone you will get a New Phone. I have been paying 10$ a month for nearly 2 Years.

Last week I dropped the phone and it got damage. I had to pay 125$ as it was my first claim with vodafone phoneinsure. When I went to drop my phone at the store as advised i was told by the Rep that with phoneinsure i will be getting a new phone. 

Claim got settled in 2 days all ok so far....

I was advised by Phoneinsure that I will be getting Remanufactured iPhone 3G 16GB which has been discontinued for almost 1.5 year. This phone might have been used by someone else... 

What a Joke.... After paying for insurance for all this time and paying them access of 125$ i would have been better off by claiming my content insurance from where i would have got a brand new phone.....

So the Fine Print of Terms and Condition which was never explained to me by the Vodafone Rep when they sold me the insurance I am stuck with paying over 350$ to vodafone for nothing...

DO NOT BUY PHONE INSURE.....

It's nothing to do with Vodafone, but to do with Apple. Apple never sends out "new" phones, unless it's a DOA problem.

Actually most large electronics companies do that. And by "refurbished" they don't mean "someone else's phone sent to me".

Damage handsets are sent back to Apple, and will have any broken parts replaced, in general a new case and fully tested. Looking at those devices you wouldn't be able to tell the difference.

It's not up to the rep to explain it to you, it's up to you to read the Terms and Conditions.  If you don't understand them, seek professional advice.

Sorry, "the rep didn't tell me" excuse doesn't wash with me.

But where does apple take part here. I am not claiming my phone with apple.

That is true, however if the rep verbally told them that buying the insurance they would get a 'new' phone if any thing happened to it, then under the fair trading act, they would need to provide a 'new' phone. Otherwise they misrepresented the product(insurance policy)

When information given to you about goods and services is not true, then a false claim has been made. For example, if you buy a shirt with a "Made in Italy" label and find it actually came from a factory in Korea.


The word "representations" covers any situation where a trader claims something about their product or services, either verbally or in writing. It can even cover cases where a trader doesn't say something. For example, neglecting to mention that prices exclude GST.

 

I actuallyhad the same issue when buying an extended warrenty for an ipod touch. I was specifically told instore that ifit failed they would just switch it straight away, and if there was a newer model, I would get a new one.  However when something did go wrong, it was a different story. In the end they did however honour it, but it was a hassle.

If this was the case, people would just throw their phone on the ground once a year to get the latest iPhone.

This is incorrect. Nowhere is it claimed that all phones are replaced with brand new devices. While this may occur it's not guaranteed.

The insurance doesn't cover the iPhone4 so you wouldn't be able to get one of these as a replacement.

Soo whats the real issue? The fact that the phone is not brand new? What difference will it make? A refurb phone is pretty much brand new...

The issue I have with them is that they are giving me something which is discontinued for almost 1.5 years ago. There is no warranty on Phone.

I could have claimed this under my home and content policy by paying only 100$ excess and would have received a brand new phone. I have been paying vodafone for almost 2 years and i am paying 125$ excess as well.

I am not expecting iPhone 4 but I am happy to settle with 3GS as well but phoneinsure reps are rude and wouldnt even listen to you.

After all I was told when i bought my insurance that if something happens to the phone i will be getting a brand new device.

It seems a bit pointless buying phoneinsure if its covered by your contents insurance anyway...? Its like insuring your car twice with 2 different companies...?

yeah, why would you pay for phoneinsure when your home contents has a lower excess?

seems absurd.

I think what you are really complaining about is that you wanted to get an iphone4 and when you 'accidentally' dropped your phone they sent you the same model you had before.

The purpose of insurance, is to put you in the 'same' position you would be in if your hadn't had the problem, not a better position. The phone you damaged, before you damaged it, it would have also had no warranty and was a discontinued model, so I don't see what the issue is. If you have a car, and the tyres are stolen, they will usually pay out on what the tyres are worth and deduct an amount for wear. It does sound like you are trying to get a free upgrade.
