Hi All,

Slightly annoyed here.. As per subject I recently bought some Sony Speakers online from a relatively well known electronics store (won't name them just yet, but it's not Noels or NH), and it looks like I got sent display/floor stock... Pretty obvious actually, the box was a bit of mess and re-taped, it even had a pricing sticker on the speaker itself..

I don't recall the website mentioning this to be the case at all so just wondering if anyone has had this happen to them and whether this is normal? Or am I being too precious?

Any thoughts/advice/opinions on what you guys would do would also be appreciated..

If it wasn't advertised as ex-display then I'd be getting a refund immediately.

That's the state of NZ retail. They probably will want you to pay the return of the goods too and get all defensive when you tell them you're rejecting them and they need to arrange the uplifting of them.

 

They probably think its fine because "it will still have a warranty" and "it looks as good as new" and "all the accessories are there"

 

How are you to know its not used when its an opened box. Time it was made illegal to sell anything opened as new like in most of the USA.

If they're not advertised as having been ex-display, you can expect either a full refund (shipping at their expense) or a credit towards the speakers.

I would guess the store is somewhere on Dominion road, as my friend had the similar experience, he ordered a brand new Denon AVR but came with 3 pin dynamix branded cable, the box also has been resealed, as he needs it in a rush,and he didn't go back to them.

Thats a little bit like a car dealer selling you a car as brand new when it had 600k on the clock (I refer to a real experience early in my career). The item is not new anymore as it's been used, and it's been damaged by having the price sticker on it (glue from the gum and so on), plus it's been manhandled and so on.

 

So yeah... stick to your guns and tell them they sent you the wrong thing. There will be protest. call Citizens Advice or Consumer to get the right words and use. and then never use that shop again

Were they discounted form their normal price?

 

If you returned them for a refund, would that refund then allow you to buy the same speakers from elsewhere at the same price?

 

 

 

It is a little bit crap that they did not inform you they were display models, but it is also quite likely these will perform as good as new, or that they have hardly even been played. I understand getting something that is obviously out-of-box is disappointing - they should have a) told you, and b) cleaned them up (removed stickers etc.).

Thanks for the responses so far guys, good to hear your thoughts on where I stand. 

 

So I did a bit more digging last night, the speaker isn't listed for sale any more on their website - so I can't recheck.. Seems a bit strange to me. I would've have expected an 'out of stock' note or something on the actual page rather than it be taken off completely.. Unless of course it was originally advertised as display stock and I completely missed it. But I'm pretty adamant that it wasn't..

 

I thought it was interesting that the 'sale' price was a whopping $2 off the stickered price that was still on the speaker... 

 

Anyway, I've fired off a 'please explain' email to them, so it will be interesting to see what they say/do.

Most likely they got caught short with stock vs orders, or were not aware that the one their inventory said they had, was actually a display or ex-display model.

 

 

Back in my day at least, it was usual to offer a display model for sale at full RRP if one could be assured that it hadn't been screwed with or mistreated, and if it could be repackaged in a way that wouldn't make it obvious. So an item that came out of a cabinet, for example, was probably fine. But anything else - especially if monkeyed with by customers - usually ended up as a last-of-stock discounted item. So if it otherwise works and you're happy to roll with it, i'd be seeking a partial refund or credit. They shouldn'tve tried to pass it off as brand-new-in-box stock if it obviously wasn't.

 

 

More likely a misjudgement than anything deliberately malicious, most retailers aren't in it to scam a few bucks from their customers as they want the customer to return. Scenario that comes into my head is HO/Web-store running out and asking a retail store to ship one, and junior salesperson doesn't realise that what they have isn't fit for full-price sale, and web-store person may not even know what's going on.

 

Hopefully they take the opportunity to remedy.

Thanks @Blakjak, appreciate the insight. Yes completely understand that mistakes can/do happen. And i'm totally not ruling out this being an error on my part so am genuinely interested in seeing what they do.

 

I am happy with the speaker itself - hence why i bought the thing, they were the only store that actually had any in stock in the whole country - even the Sony store hasn't had any in stock for a while; so was pretty happy when I saw it on 'sale'. The courier sticker still on the box had a delivery date of 2016 - so they've had it for a while...

 

With the limited availability of this speaker and the hassle of sorting out a return, I think I would be happy with a partial refund/credit. Of course it all depends on how this plays out. Wait and see I guess.

So update for those interested... Ended up calling them after my email to them got lost in the ether... But CSR I spoke to was very apologetic for what happened and said they usually call their customers first to confirm if they intended to buy display stock etc, but for whatever reason this was missed... 

 

They proposed a partial refund of $100 off the price I paid - which I accepted based on the conversation I had with the CSR and the fact that the speakers are pretty hard to come by now.. The speakers used to retail over $550 new, so to get them for $200 (albeit ex display stock) is pretty reasonable. Don't think they would've gone much lower than that. 

 

While not a great experience, happy with the outcome. Thanks to all for your input.

I applaud your reasonable approach to this. Whilst it's possibly without your rights to throw your toys out of the cot as seems encouraged so often in these forums, if all parties can be reasonable and everyone gets something out of the deal, then it's a no harm no foul situation. 

 

If the retailer makes a habit of this however, then it's a whole other kettle of fish. 

 

 

 

Enjoy your speakers. Appreciation of sound is one of the most wonderful things that separate us from other animals.

I am not, as you are perfectly aware, suggesting that people don't stand up for their rights. You can stand up for your rights without being a right ahole about it. 

 

He got a perfectly reasonable offer from a retailer who (at face value) made a genuine error. They made no attempt to discharge their liability.

 

Retailers are full of people, who as you are aware, are fallable. Even with a company policy clearly in place, people will bypass those, or fail to follow them for a variety of reasons. There ARE retailers who as policy will try it on first time, and throwing the book at them is a great way 

 

for them to learn a hard lesson, but I feel in these forums from time to time, are a group of people who believe no benefit of the doubt should be given, and an attack at the jugular is always the best course of action.
