Finch: What do you know, I didn't receive a call today as promised from Dick Smith. If I haven't heard anything by Thursday (Will be 3 weeks then) I will be asking for my money back, does that sound fair?

IMO no, the person could have been busy and forgotten, or they may not have been able to get the info from the repair company. why not go into DSE and stand with the person while they talk to the repairer and get them to find out what is wrong and how long it will be.

The DSE guy has given you an estimate on how long it will take to fix, and saying they usually take about a week doesn't mean it will take a week.

you need to ascertain what is wrong with the phone and why its taking so long to fix before you go asking for your money back

When I rung up on Friday the DSE salesman said he will give the repairer a ring and find out why it is taking so long and get back to me on Monday. Somebody isn't doing their job correctly.

One thing I'd like to add is, you're not entitled to a refund if there is no issue or you caused problem/damage.

I agree the service you've received appears poor at this point, but you're not doing all you can do either.
TBH, it sounds more like you're just looking for a way to get a quick refund.

I was told that if the repairer doesn't find a fault or I caused the problem I will be fined $55. However I know I have done nothing wrong. Service is very poor thus far, nobody seems to know what is happening. I don't necessarily want a refund, my phone is nearly 1 year old. In an ideal world my phone wouldn't of got any problems and I wouldn't of made this thread. I want my phone back however if it is going to take 3+ weeks I would like money to buy a replacement phone. Questions need to be asked especially since I have been told "1-2 weeks", "lately repairs have come back in less than 1 week", "2 weeks give or take".

Will either pop in tomorrow or just ring again on Thursday if I haven't heard anything and be more assertive.

it doesnt matter what they told you about others phones and the repair time on those, they are not your phone, they may have been easier to fix, your's might not be.

the sales person might have been busy and forgot, you are not their only customer. if you want an answer you will go in and wait while they call. that way you know its done
