Apparently, the ISP in question were "throttling" our connection. Once they remove that we will be able to see what's what.
Are there some types of throttling that could cause a connection be to approx 10-15% below the stated speeds?

Short answer yes... Longer answer, I know of situations when an ISP may shape (not throttle) to below the line rate in order to improve the customer experience, but it's uncommon and usually to work around a customer end issue. I don't know if that's what happened here, but short answer, yes.
