with the benefit of hindsight, the best option in the future would seem to be asking the store to fit any sim adaptor you want to use. Then if it breaks off in the device you have a much stronger case for it being their fault.

Hi Everyone,

I've got some really good news. I spoke to the store manager again today and we managed to come to an agreement. My new cell phone will now get fixed and the store manager has restored my faith in his business. I am really happy now and will definitely be staying with Telecom :-)

To all those who helped me with this issue, thank you very much!

Good to hear that you came to an agreement.  Sometimes it is best to simply get in a room and talk about things to come to a resolution.

Absolutely.  Telecom retail stores are very good about providing service for products you buy there.  Installation is just part of the job.

My friend bought a Note II and slotted his sim in with an adapter, no problem. I watched him do it.

Obviously, there is always the chance of bad luck I guess.

I've used adapters for years (micro) and just recently (nano) without issue.

It's great that Telecom sorted the issue out for you. I have found their in store service is really good and while (I feel) you are probably quite lucky that they helped in this scenario, it does show good customer service.

The only question I have... is it possible the sim card slot never worked? :-) ie. DOA. I guess we'll never know unless you used other sims in the Note II before switching.

I don't think it is about customer service though, I think it is about possible risks and  insurance incase something goes wrong. I mean a customer may take a faulty phone into the store unknowingly, the staff may install the sim, and the customer may then say that whatever they have done when installing the sim has caused the phone to be faulty. When it may not have anything to do with that, but a manufacturing fault. This would be different than if they had actually sold the phone at the same time they inserted the sim, because if faulty, then the store can just send the phone back to the manufacturer as DOA. Not so easy when they didn't sell the phone.
I know in other fields not related to cell phones, that if you want something like this doing with something third party, you often have to sign a waiver to accept that they aren't liable for any damage that could be caused.

What is the SIM tray in a Note II like?

I've used SIM adapters many times before, and they are 100% fine in some phones, and very dangerous in others.

I have a Nokia phone that the SIM slides in on an angle and is held in by a raised edge that can be pressed down to release the SIM. Problem is, that with an adapter, it bends over the clip but the SIM doesn't and gets stuck. Real PITA to then get the SIM out without damaging the phone or the SIM.

In my opinion, and I have successfully used the CGA several times and have a VERY good understanding of the law, I believe you would have had a strong case here if it has gone to the DT, if presented in the right way.

You gave the store all the info they needed to sell you the right product, they are the experts and you can expect to trust them and they sold you the wrong product. They should have known better and it's not your job to. Particularly if your phone has a SIM tray that is susceptible to a SIM in an adaptor getting stuck, I very much think this is a reasonably foreseeable outcome of them selling you the wrong SIM.

At the time of the original purchase, did the store offer any explanation as to why they were supplying a Nano rather than a Micro?

I think the adapter I had had a slight defect because the nano sim kept slipping out of it before I was able to insert it. If the nano sim hadn't been so loose in its adapter then I probably wouldn't have had any issues.

It is possible but very unlikely. I think the place I brought it from gave it a quick check before sending it.

I think it is not has thin as the SII one, because I had taken the nano sim and adapter in and out of my SII about 3 times without damaging the phone. The sim kept slipping out of its adapter just before I was about to put it in. But as soon as I had put it in, the sim reader held them both together quite well.

I think the sales assistant said something about it being universal. She probably thought she was doing me a favour in case I ever brought a nano sim device.

Interesting. Probably right. I just happened to have a spare Telecom prepaid nano sim (I bought to give to someone but in the end they didn't need it).

I just popped it into the adapter now and it kinda clipped in, so it doesn't fall out (even if turned upside down)... so perhaps you did have a defect adapter.

What I also noticed (this is brand new)... is that when pulling the adapter off the plastic surround card it comes in, it can be bent quite easily. This adapter seems good in design (shape) but the plastic is not stiff enough so it may get damaged (bent out of shape perhaps) when detaching it.

My other adapter is using plastic that can't flex as easily.
