But it's so unfair to have rules that are available to be read and enforce them. It should only apply if I win an auction that is undervalued.

Leximus: Hello guys.
I had some truble with the admins of Trade Me, i was wondering if i can get some input to my case.

I had an account, which i had traded with without a problem(only positive feedbacks). Later on i was selling items for $1 reserve. A buyer won the product but is wasn't enough for me at the end of the bids. Since i had the option to give a "fixed price"(program fault) to the buyer, i took it, and then i got a negative feedback from the buyer/s. i had a little argument over the feedback with the admin of trade me. That account got deleted and banned. Acceptable, but of If I had no option I'm not going to be using it.

Probably a month after i created another account. I was happily buying - sale items, but when i went to sell again, i had to confirm my details (even though i had address confirmed). It was no problem for me, but they found out that i was the one with my previous account.

They said that they are banning the second account(only with positive feedbacks) because i had exessive (20 positive 3 negative) negative feedback from my previous account! I reckon its pretty unfair to make a decison without looking around the circumstanses, and they blame me for breaching terms and conditions.
I really want to fight for the trouth, so can you guys give me some advice on what i sould do? Or if you think i was at fault?

As so many others have already said - you are most definitely at fault. You should probably be banned from here as well for soapboxing! (it's against the FUG you agreed to before being allowed to post anything)

jeffnz: as an aside, why would it let you go $1 reserve then give option to do fixed price once auction is won?


Not really a bug but a feature

It allows you to offer the item to other bidders or watchers :

a) if the original sale falls through (but there's no check to confirm that) or

b) if you have multiple items of the same for sale

Some retailers will list an item at $1 reserve and then make a FPO to all bidders afterwards

What is a small issue is that if someone buys the item, I think it has the same auction reference so identity confusion can happen


As an aside, is permanent banning fair? Is this like a permanent ban of the internet? (I know not quite the sme)

Thou shalt have the right to use Trademe? Yeah nah... 

Being banned from trademe for being an idiot doesn't preclude him from using the rest of the internet, don't see any problem with it.

Trademe can set their terms and conditions of use and ban users at their own discretion, end of story.

Thanks for the reply!
The only think i forgot to tell you, i never used trademe before for sale always bought something, that was a first time, of course it is not  an excuse, i could have read the rules!
I accepted I made a mistake on TM, but they did not let me prove I can do better, and I did. Doesn't matter now.

Sure Leximus is in the wrong. And sure a ban would probably be waranted. But is this not too harsh from TradeMe?

Remember Leximus was the seller in this case. The person who bid on his $1 is not exactly at a loss. Hence I do not see the big deal, Leximus received his bad feedback which was waranted? And thats what the rating system is for is it not?

There are many people trading on trademe, people selling from china/etc and even delivering from China, and probably not even based in the country. I have highlighted such a seller to TM, wh sent me a fake kindle cover, advertised as geniun and new from Auckland. It arrived fake and from Hong Kong. The seller continues to trade and my item Kindle cover made the bin. $30 loss.

Another example of people who should just walk to Dick Smith and buy something legit instead of trusting that Trade Me purchases are the best thing in the world. I bought a Kindle cover at DSE for $30 and I am covered by their warranty and CGA.

As discussed in the other thread (linked earlier), these sellers of fake products do well because people buy things without checking retail prices. Many times I saw people buying second hand mobile phones for more than they sell brand new in stores...

There is one more think!
After if someone won the item at reserve, the TM program shouldn't be give me or anyone an option to incrase or negotiate on the "won" price, but its did. If someone won an item and reach the reserve price already, dont give a chance to change anything on that item, isn't that? But thats happaned with me!
The buyers did not loose anything they did not pay for the items. They wrote a negative feedback thats all. But not delete my account! Every people can make a decision, buy from me or not after this. I purchased an item from a member who has nearly 500 negative feedbacks and nearly 29000 positive ones. I was that person who decide i still need that item or not.
Yes thats what is rating for

I still feel bad about what happened, but i had no chance to prove otherwise!

Nobody in NZ was stocking Kindle 4 cases last year. Let alone Kindle 4.
