I'm also having the same problem! Disabled texts and selected only emails. Very annoying
Edit: Skinny's response after they told me to turn off promotional notifications in settings (which I've already done): "Unfortunately, there isn't any further options to turn off this notification"

there is no way to stop these messages
i have tried turning off all my notifications in my account page yet still receive theses

- Select "settings"
- Select "change your notifications"

I like to think the Geekzone community is influential and can get it sorted long before the DIA gets around to looking at it, assuming they determine they aren't blocked by legislation.
"Messages delivering goods and services, including product or upgrades, that the recipient is entitled to receive under the terms of a previous transaction [...] don't have to contain [...] a functioning unsubscribe facility."
It doesn't give section numbers so I'm not sure whether or not it's referring to 6(b).

Your OP says this is a promotional message - those subsections are about status of current services so I don't see how they apply. Also section 11:
11 Commercial electronic messages must contain functional unsubscribe facility
(a) the principal message includes a functional unsubscribe facility that the recipient may use to instruct the person who authorised the sending of the principal message (the sender) that no further commercial electronic messages from or authorised by the sender should be sent to the electronic address at which the principal message was received; and
(c) the unsubscribe facility allows the recipient to respond to the sender using the same method of communication that was used to send the principal message; and
(e) the unsubscribe facility is reasonably likely to be functional and valid for at least 30 days after the principal message is sent; and
So based on that they are in breach of the Act and you have the right to complain to the DIA seeing your approach to the company resulted in no action being taken.

The OP is not clear if the message is about the current subscription contract and a service he's entitled to, or a message offering add-on services. If the later then I think my previous reply applies. If the former then the OP will have to live at the mercy of the provider one day fixing their systems...

To clarify, this is something which is being given to subscribers whether they want it or not. It's promotional in the sense that it's being advertised as an incentive to sign up to Skinny. The texts do provide factual information relevant to a subscription, which is permitted under 6(b)(iv). It is however over and above what I subscribed to and unnecessarily repetitive. Unfortunately, the legislation doesn't draw a line on how much factual information is too much.
I'll wait to see what Skinny comes back with in response to my ticket, then decide if a complaint is warranted. I do consider this to be promotional however.
