Exactly. If it was a problem, then Uber Eats wouldn't exist, nor delivereasy etc.

A quick search leads to this article from Consumer NZ indicating they intended to file a complaint with the Commerce Commission regarding this practice. I actually have considered doing the same, not just regarding this issue, but also other practices from a certain 'restaurant' chain.

 

It comes down to price clarity. As noted in the article, the Fair Trading Act makes it an offense to "...make a false or misleading representation with respect to the price of any goods or services." Adding additional delivery costs is fine. Adding a handling cost is fine (although arguably not reasonable given in-store purchases are handled in the same way). Adding a hidden service cost to every single item being purchased, in addition to any delivery/pickup fees, misrepresents the cost of the goods and services.

How has Uber not run afoul of this then? Prices can be 30% higher via Uber than via the restaurant directly. I suspect it's not as clear-cut as you believe. It's also worth noting that article was 9 months ago and no complaint laid. 

 

I believe it would be easy enough to skirt for these companies by simply 'clarifying' via a banner that food ordered via their online platform may be more expensive. It might make you feel better, but wouldn't make you any better off.

I'm not referring to Uber Eats at all. If they are clear about their pricing structure, then there is no issue whatsoever with the service they provide. The issue is how KFC represents pricing of products purchased from their online ordering system, where additional fees are levied, undisclosed (See bottom paragraph, these are disclosed in the T&C now). Clarification is all that is required. They can charge more, they can't mislead.

 

As for no complaint being laid, how do you know that? The Commerce Commission does not keep complainants informed of the status of their complaint. Unless they require additional information, you will only receive acknowledgement that the complaint was lodged. They take the information, consider it along with other similar complaints and take action where appropriate. If they do determine there is a potential breach, investigations could take many months, and you may never hear about it.

 

I see the KFC terms now state the following "*The cost of delivery is captured through both the menu price and the service fee". I guess someone has already pointed this out to them, possibly the Commerce Commission.

People also get angry when the instore prices at dominos are higher than you get in the app or online, which I really think is fair enough. If a price is advertised in a place that you do the order its fine for it only to be valid in that place. If its a price on a billboard or something it should say how the order has to be placed to get that price IMO.

Since Consumer’s initial investigation into hidden delivery fees, KFC, Pizza Hut, Carl’s Jr and Taco Bell have added ‘Menu Pricing’ to their terms and conditions: “Menu prices may differ between delivery and pick-up due to the different associated costs and the nature of those services. The cost of delivery is captured through both the menu price and the service fee.”

 

Consumer lodged an official complaint with the Commerce Commission, asking it to investigate.

A much smaller Yellow / Whites pages pushed into my mailbox despite the fact I have no circulars. Into the recycle bin. What a waste of resources.

 

About the only use I can see is to swat fly's, wasps and spiders!

Updating my android box and from Play Store downloaded the Three Now app as well as TVNZ+ the latter signed in and working fine. The Three Now app after laboriously typing in name and password with the mouse, spat out a you can’t sign in to a jailbroken device. Uninstalled it.

Got some new medicine today where the "directions for use" say, and I quote, "1 capsule daily with food". That's it. So do I swallow it whole? Open it and mix it with water? Sprinkle it on my dinner? How hard is it to actually, you know, have some directions where it says "directions"?

My uncle went to his GP because he was constipated and got a subscription for suppositories.
