Hi ya all, we are renting in Chch and the rubbish bin magnet fell apart (the type where it's like a drawer next to your kitchen sink - there is a level underneath the drawer and you push it with your foot the the drawer opens - and inside it lies 2 rubbish bins).

So we told the rental company and they arranged for this handyman to fix it. He told us that the part is no longer available so he'd supaglu it back. I asked him how much as we're the ones paying. He said $50. But 2 months later the bill came from the rental company for $120.

Is the commerce commission going to be able to assist in such a small problem? I mean for one i don't think it costs that much to fix. Secondly he specifically told us $50, we expected a direct invoice from him later that day but darn i was out when he came back, and now he's blown it to $120 to supaglue a contraption that will probably breakdown again after being used 3 times (we havent touched it!!! we never use the bin but had some guests over who used it and broke it).

Too small for Fair Go?

Please help!

Did you get a copy of his invoice? Or is this one from the rental company?
I would consider contacting the company/person who did the repair work, and ask them again.

Did you find out what their call-out fee was? That may be $70

Did you get the pricing in writing? If not this will be an uphill battle.

Pay the bill, but only send a $50 cheque with an explanation. They may take you to a debt collection agency, when you get notice from them, inform them in writing that the debt is in dispute, then you'll have to go to dispute tribunal to put your case forward.

Or you could just pay the $120 and never use that company again. Up to you.

Seems strange that you had to pay to get such an item fixed, I would have assumed things like that were covered under upkeep and maintenance or considered acceptable "wear and tear", our landlord unblocks the spouting's, fixes the locks and tap washers/hoses and the like as part of the upkeep. Last place was the same, lock fell apart and they arranged for it to be repaired no charge.

Name the rental company too. Sounds like it might be prudent to steer clear of them.

i have tried to argue for months over who pays as i swear we don't use the da** bins! but someone touched it and it just fell apart ... *sigh

let me search the govt tenancy site later to see what it says about these things

Thats insane, if the bin was broken that easily chances are its been like that for a while. I haven't used IronBridge but I've used Brazzer and they're all a much for muchness. Our kitchen lights in my old flat started to blow a fuse every time we used them so we taped them off and called our rental company. They never fixed it until after we moved out (despite many calls and two flat inspections where they where shown the problem) and than they had the balls to try to charge us for the repair. Needless to say we threatened the Tenancy Tribunal and the bill was dropped.

If there are any disputes of this nature than the Tenancy Tribunal will be able to offer advice. They have a contact number (can't remember sorry, too lazy to Google) where you can get advice on your rights in this situation. The Tenancy Tribunal *should* hold your bond in trust for your landlords so if IronBridge try to claim the costs out of your bond when you move out don't sign the bond release form and challenge the final costs. These property management firms are all the same, they try to milk every last cent out of the tenants and bully them into complying.

Hi

I belive this is something your landlord has to pay for. But have a look at this site http://www.dbh.govt.nz/ it has everything you need to know about landlords and tenants rights. Also being a landlord myself I am paying for all the repairs in my rental properties.

Your landlord should be covering this. When I get repairs done, I don't even see the bill.

thanks guys for your help i will take it to the rental company first, as ringing the handyman could mean i'm taking liability. when it eventually unfolds i will let ya'll know the outcome!
