Ive googled problems with Mobilefone Repair and signed up to get my prob out here....

I got the design fault hairline crack down my phone on the back from the earjack to the silent switch and was advised by Apple to send it to MFR. I recieved their report stating my phone is water damaged....I am soooo careful with my phone and have never had it near water. Ive found other complaints about them saying water damage when this isnt the case. Although now htat is the report they say I have to pay $55 to get my old phone back or $486.30 to get a replacment. As it is a known design fault I think I should have my phone fixed and as apple say there is no shop here to fix it then it should be replaced...ive asked for proof off the water damage and they arent returning my emails and customer service are saying theres nothing they can do because its what is in the report. I am an apple customer that has paid in full for a product that turns out to be faulty.

Spoke with Apple tonight and they said I could send it to Australia and get them to replace the part because yes it is a fault but I have to pay for the sending and the part and labour.

This seems odd as Apple came up with a solution for the design fault of the iphone 4, yet they are not going to fix their design fault of the iphone 3GS as I should deserve.

Im not going to believe my phone is water damaged as I havent had it in or near water AND there was no functioning problems showing any sign of short circuits. I dont know what avenues to go down when Apple wont accept responsibility for a fault in their product that they should fix and MFR well im not getting anywhere with them!!

Water damage, a classic line really. Don't believe it if you honestly can say you haven't put it near water. Sometimes condensation can cause the "colour" to go off inside to phone which tells them it's water damaged.

Yeah I got told about condensation as well but we have an HRV system in the house and dont get condensation...im wondering if MFR have condesation????Ive heard that they give a lot of people that excuse and i honestly beleive they are wrong about my phone...but so much for Apple standing behind their product!

Moisture doesn't cause plastic to crack! It seems bizarre that they would refuse to repair your device based on something that's not even relevant to the fault at hand!

Who did you actually buy it from? Did you order it from Apple direct?

I got it off Apple online so yeah directly from them spoke to a guy tonight after a few other customer reps and just kept getting told how water damage happens and how they can tell. I said how come Apple ont help in this situation and he said he would try and talk to them to get my phone sent back without having to pay, but they wont replace because of the report...If it as a cheap phone then I wouldnt worry about it but its an $1000+ phone that has a design fault and no one will listen from Apple or MFR, ive emailed Steve Jobs but no reply the only other option my friends and family think I should do is go public.....FB page, Fair Go, Radio Stations, Newspapers or even disputes Tribunal.

Makes me wonder if people with the new iphone 4 have water damge does that mean Apple ont take responsibility for the arial problem????

Your totally right though water damage doesnt create cracks in plastic.

If the phone stops working - Water damage.
If the phone has a crack - water damage.
If the phone does random stuff and is slow - Water Damage.
If the phone ownt charge - Water damage.
If the phone is gone - Water damage.

I never bother taking my phone to get it repaired anymore, Water Damage is always the excuse. If the phone was not designed to be put into a pocket or in high humidity areas i.e. during summer... then its a DESIGN FAULT!

Just get phone insure and you'll be sweet =]

As the retailer Apple is obligated to repair or replace the faulty product. I think your best bet would be to serve them with written notice calmly detailing the story so far, and advising that you will file a claim in the Disputes Tribunal if they don't offer a satisfactory resolution within 7 days of receiving your letter. If that doesn't get a result then go ahead with a Disputes Tribunal claim.

You need to be a bit careful what you put in public forums in case it prejudices any legal action that you may end up taking.

I have been in contact with Apple and yes they will admit its a fault but are still not prepared to take responsibility. Have informed them of me putting a claim with the disputes tribunal and after a while they eventually gave me the adress of their legal department in NZ. Also have been contacted by a reporter wanting who will be interested in this case when I do take them to the disputes tribunal, am having a great response so far from a FB page I have set up "Edith takes on the Big Apple" feel free to join :) and also have been told by a friend studying commercial law that im within my rights according to the consumers guarentees act 1993 according to section 6 and 7. Wow gong to save on legal costs!!!Feeling very confident....Apple has requested MFR to open my fone and scan the inside to show how extensive the water damage is so they, I asked to be cc'd in the report and was told they dont usually but the customer service rep was going to check with the technical team!!Yay all round things are moving.

Just wanted to let you know I got a result for being persistant and calm....but had a lot of support from the media and friends and family. They have apologised and are replacing my phone!and I wont be charged anything!

And all in only two days. I've always found persistence and calmly stating the facts works for such disputes with buisinesses. In most instances they will turn their decision around once you state the facts that show you are correct. Well done! :)

BTW: Water Damage is probably a stock-standard response for damaged phones. Never believe it.
