I had an iPhone replaced under warranty...
The phone didn't allow callers to hear me, unless I talked via speakerphone.
The store I purchased it from sent it to the Vodafone repair centre, they did a factory reset.
It came back - and guess what? It kept doing the same thing.
I then rang Vodafone, who denied it was their fault and blamed Apple.
So I called Apple over in Aussie, who told me to send it to them...
I did - and received a new phone (not refurb).

...same problem surfaced.
So I sent it back to Apple... who send me another brand new one.
This time people could hear me, but I couldn't hear them. *sigh*
So back the phone went to Apple, who sent me a new one.
This time it went back to replicating the original fault.
So back to Apple it went - and another brand new phone was sent to me.

Guess what? Same issue.
So I 'politely' called Vodafone again, who said they'd reset my profile just to appease me.
And guess what? It's been fine ever since.

The point I'm making (all be it in a convoluted manner) is that I didn't receive a refurbished phone at any point by dealing directly with Apple. BUT - before you go through them, you should go through the Vodafone repairer first - if they can't sort you out. Apple will :)

How do you know it was brand new? Dont the refurbs look like new ones? (new casings etc)?

When the lady filled out the repair form she didn't mention it was an out of box fault, but I included the receipt so that should prove it's new. I'm hoping I don't get a new one, because with my bad luck it'll be broken again. I hope they can repair it because it's perfect about from the tiny black square. If they can't repair it I'm getting a new one and if they give me a refurbished one I'll just talk to vodafone :).

HAve personally had 4 (or 5?) iPhone 3G's replaced by MFR.

All of which were claimed to be brand new.

They did on the spot replacement in Auckland, Mt Wellington.

I wish it was that easy here in Christchurch. I'm still waiting to get mine back. It's been 7 days now

Yeah, bought the phone and an hour later took it back and they said they were sending it away. To Auckland I geuss. They said 10 days and I'm not sure if that meant 10 working days or just 10 days. Got my phone back today, turns out they rang me 2 days ago but I didn't have my phone on me, and decided not to call back because it said "Blocked" and it was past closing time. They rang me today, and they said it was a new iPhone which to my surprise has absolutely nothing wrong with it :) So turns out they rang me after 5 days, not ten, so it was a lot quicker than I thought. I got them to activate it instore and I checked it. I know this isn't vodafone's fault but apple's policy, but it's a really stupid one. I asked if it was repaired and the lady said that it was too expensive to repair so they just send a new one, which pretty much defeats the purpose of having it sent off to be inspected when vodafone could just give me a new phone on the spot.

I guess it all depends. Somebody at our work was complaining about the poor battery life on their 3GS. I took their word for it and send it back to VF corporate who sent it to Auckland I guess. It came back after 3 days and it was a completely new phone.

MFR said the phone had faulty wifi (which the user had never used - actually had never even loaded a song on the unit!) so it was replaced. I can't see how the sudden poor battery life related to the faulty wifi unless the wifi was on all the time and at max power. He wouldn't have noticed that though.
