Kyanar: I see a lot of people talking about taxes, which is... well, a little irrelevant.  At maybe $500 a year if what the OP says is correct, this is well under the $60,000 threshold for registering for GST.  See: http://www.ird.govt.nz/gst/gst-registering/register-who/

Now, this does still place an obligation on the OP to meet Consumer Guarantees Act and Fair Trading Act obligations and I would hope the OP isn't trying to "wheedle" out of those.  (And shame on anyone who is).  But taxes are kind of a moot point when they aren't applicable in this circumstance anyway.

GST not applicable, earnings related tax is applcable

Still irrelevant, since income tax applies to this scenario whether the OP is "in trade" or not.  So it remains a red herring.

Yes but it depends if you declare those earnings from trade me or not. If in trade then you would need to.

If not in trade you still need to.  What's your point?  Your income tax obligations are completely disconnected from your "in trade" status so all this tax talk is completely besides the point.

If you are selling the odd thing you have purchased etc and no longer need there is no tax liability on that, however if you are buying/making items for the purpose to resell there is a tax liability under Tax legislation, also there is an obligation under consumer law therefore the listing as 'In Trade' is linked to both Tax and Consumer law and is relevant here.

And if you mark yourself as In Trade or not, that liability still exists.  Hence, it remains completely irrelevant to the discussion of why or why not the OP does or does not want to mark their account as in trade.

OP : What should I use instead of Trade Me?
Everyone: Whatever you do don't bother with Wheedle it's a steaming pile of excrement and nobody uses it.  Trade Me definitely your best bet.
OP : So I'm using Wheedle... sure hope people come buy stuff

Why bother asking?

Increase in fees. Their over zealous removal of listings. The absolute twats you have to deal with who offer stupid offers. Then the other end where you get people wanting too much for their very old stuff.

$2k for a projector for which the newer model is being listed for $800 CHEAPER, does the seller lower their price? No. But it's been listed for a year.

I too fail to see you point. If you are not in trade yes the liability still exists if you are buying and selling for profit. However if you are intrade it would then be obvious to the ird that you should be paying tax and had CGA liabilities. So it is very relevant and appears to be one of the reasons the op started the topic in the first place as they didn't want to be considered intrade due to these things.

Trademe is very good for its prime purpose, buying and selling. We recently listed 5 things we no longer needed, put them on for one week and they all sold for more than we hoped for and we were paid for within days and the stuff gone. Absolutely painless.

Also people complain about the fees. However auction houses charge a lot more. It tends to be 15 percent plus gst for both the seller and the buyer which is a lot more than trade me, without trade mes reach.

Trademe doesn't have the same overheads as an auction house. Not really a direct comparison

Are you sure about that, do you have evidence as to the Trademe overheads in comparison to say Turners?

From their "about us" page:  Staff count: 200

Running a busy and successful website is not trivial, or cheap.

Their overheads are not the issue - do they offer the same service (auction and sales) and do they bring buyers and sellers together? They do. Therefore if they choose to charge around the same as a similar business (auction house) offering a similar business - good on them.

I would say it is a very good comparison, because I think people potentially have been success on trademe selling things, with a far lower commission. Auction houses aren't doing as well as a result. Plus many auction houses also have websites where people can bid. Also I would think trademes overheads are a lot higher as running a website like that and all the staff their employ isn't cheap.

For what it's worth, both Turners Auctions Limited and Trade Me Group Limited are publicly traded companies, so the evidence is actually right there in their legally required, audited, annual reports.  I haven't read them, so they may disprove Kopkiwi's statement.  But it's there nonetheless.
