kiwiboi: I've had enough of this XNet speed problems. I've been with them for a few years now, but it seems that their service is just unacceptable lately. It's been almost 4 weeks that my speed slowed down, just like you guys, I can't stream YouTube videos anymore, download speeds dropped to 10kbps or lower sometimes. I'm now in the process of moving to a different ISP. Shame, XNet used to be the best around. Goodbye XNet.

I've known about this thread for a while but have resisted posting until now. I have been with Xnet for about a year and while I generally have been very happy with them, in particular with their excellent presence here and the attention Maverick gave to solving some issues I had with VFX and Xnet.
However it is getting to the point where I feel I actually have no choice by to seriously consider changing ISPs. Evenings and weekends our internet is becoming close to Dial Up speeds. National is fine, I can get 5Mb+ to Xnets speedtest.net server, however at the same time I am getting sub 400k to the states.
One of my main reasons for staying with Xnet was the waived VFX fee, however I also have a line with 2talk which I find to be easily as reliabe as VFX, however has a much much much better feature set.
Xnet, im sorry to say but if this is not sorted within the next couple of weeks i'm gone. I don't want to go, but you leave me with little option.
and if you may think thats for 'external' people and not relavent to Xnet customers --> Xnet customers then:Prohibited Uses
Prohibited uses include, but are not limited to, using the Xnet Service to:
- Restrict, inhibit, or otherwise interfere with the ability of any other person, regardless of intent, purpose or knowledge, to use or enjoy the Xnet Service, including, without limitation, posting or transmitting any information or software which contains a worm, virus, or other harmful feature, or generating levels of traffic sufficient to impede others’ ability to send or retrieve information.
- Transmit unsolicited bulk or commercial messages or .
- Interfere with the computer networking or telecommunications service to any user, host or network, including, without limitation, denial of service attacks, flooding of a network, overloading a service, and attempts to “crash” a host.
Excessive Use
As Xnet is a shared access to the greater Internet, it is the users responsibility to ensure that their actions on Xnet do not impact on the experiences of other Xnet users. Therefore WxC will take action on specific users that are deemed by WxC to be utilising XNet resources excessively with the possibility of impacting other users. This inculdes but is not limited to the ammount of data that may be downloaded in a month or part of a month.
WxC may:
- Warn the customer that continued excessive downloading may result in further action
- Shape, filter, exclude or prohibit the further downloading of further data - either in its entirety or apply this on certain types of traffic
- Continued excessive downloading may result in the cancellation or suspension of the account without warning
- With regards to a dial-up connection, this connection must not be used as a permanently connected service
WxC will at its discretion reset your connection to ensure that the service cannot be used in this manner.

I can understand not enforcing the other parts of their policy such as 'illegal matterial/copyrighted matterial' but it seams Xnet are not upholding their Policy when it comes to degrading the service of other Xnet users.
If that isnt enough then maybe the NZ Consumer Guarantees Act which clearly states that the service provided must be fit for its intended use. Which the Xnet broadband service is not, because webpages & resources do not load within an acceptable period of time, and after 12 (midnight) some websites time out, not because the site is dead, but because of Torrent plan users exhausting the avaliable bandwidth (which conflicts with the Xnet Policy stated above).

I know that I and most of New Zealand is asleep and if you want faster speeds during the night:
CHANGE PROVIDERS
Easy. No contract so no termination fee.
Also, in the terms and conditions we find this line:
We do not guarantee that the service we provide will be perfect
so there you go. All your whining and moaning is going no where.
chrisjunkie: Well I am one of those torrent users and to tell you the truth I really dont give a **** that you cant use the internet after 12am.Thats nice, but I'm more complaining about the crap speeds during the day and under the Consumer Guarantees Act I'm well within my rights.The line "we do not guarantee that the service we provide will be perfect" is not in question, its the fact that the service is unusable and therefor not fit for its intended use, so you need to actually read instead of blatently going out and being arrogant just because your on the Torrent plan and abusing the service to the point that others are affected (again against the Acceptable Use Policy).

Folks. I am locking this thread now.
As you know the ISP is aware of the issue. So much so that they even stopped coming here to see this discussion.
I believe many of you have already called their help desk and made your opinions known. If not, I recommend you do it so.
